ACKNOWLEDGMENT AND RELEASE: I understand and acknowledge that:(i) I am buying a bicycle that has been donated to Second Chance Bikes.(ii) Second Chance Bikes is transferring to me all of its right, title and interest in and to the bicycle, but Second Chance Bikes is not warranting title to the bicycle, and (iii) the bicycle may be defective and is being purchased “AS IS” WITHOUT ANY EXPRESS OR IMPLIED WARRANTY, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND WITHOUT INSTRUCTION AS TO ITS USE OR MAINTENANCE. In consideration of the sale to me of the bicycle, I hereby release and forever discharge, and agree to indemnify and hold harmless Second Chance Bikes directors, employees, volunteers, agents, representatives, successors and assigns from any and all claims, causes of action, damages, injuries, losses and expenses of any kind arising, or alleged to have arisen, out of the use of the bicycle any time hereafter by me or any other person. *NOTE: IF BUYER IS UNDER 18 YEARS OF AGE, BUYER’S PARENT OR GUARDIAN MUST FILL OUT THIS FORM *
